企画趣旨
　「重国籍／複数国籍」をテーマとする本学会の取組みとしては、2018年5月の移民政策学会年次大会のミニシンポジウム「複数国籍の是非と『国のあり方』―国籍法と実態のギャップから」が開催されている。本企画は、「複数国籍」をテーマとする2回目の企画となる。

　新型コロナウィルスの猛威が収束し、あらためて人・モノ・カネ・サービス・情報などの国境を超えた移動（グローバル化）が進展する中で、近代国家が発明した「国籍」についての問い直しや「複数国籍」の検討については、法学・政治学・社会学などの諸分野において展開が見られる。

　日本では、女性差別撤廃条約批准のための1984年国籍法改正の後、国籍法3条違憲判決を受けた2008年国籍法改正により、衆参両院において、①重国籍となる子どもが増加すること、②重国籍に関する諸外国の動向を注視する必要があること、③日本における在り方について検討を行うことを内容とする「附帯決議」が採択されたにもかかわらず、その後、法制度面での進展はない。

　しかし、外国に居住する日本国民が「自己の志望」によって外国の国籍を取得した際に日本国籍を喪失させる国籍法の規定（11条1項）に関する違憲訴訟がいくつか提起された（「国籍確認等請求事件」、「旅券不発給処分無効確認等請求事件」など）。日本の裁判所は、いずれの訴訟においても「国籍唯一の原則」は合理性を有するとし、原告らが主張する憲法10条、13条、14条1項、22条2項等違反の訴えを斥ける判断をおこなっている。

　しかしながら、2020年段階で国連加盟国の4分の3以上の国が複数国籍を許容する法制度を有することが認識される中で、日本においても、「国籍唯一の原則」の合理性・正当性については、再検証する必要があると考える。

　そこで、今回のシンポジウムは、この問題の専門家である諸会員から登壇していただき、あらためて「複数国籍」の問題を検討し、「国籍」とは何かを再考する機会としたい。

＜難民インタレストグループ＞

趣旨：
　2023年の入管法改正により補完的保護制度が創設され、12月1日から運用が始まった。同制度は、迫害を受けるおそれを抱く理由が難民条約上の5つ（人種、宗教、国籍、政治的意見、特定の社会的集団）以外のもの、なかでも「紛争避難民」を始めとする不特定多数への無差別暴力にみられるように、必ずしも条約上の難民とは言えないものの国際的な保護を必要とする人々を、各国政府の方針に基づき難民と同様に保護する仕組みである。迫害のおそれ（烈度や蓋然性）は必要とされるものの、その理由が前記の5つ以外のものであるとか、そもそも個々に属性や信条に関わる理由が存在しない（例えば国際戦争、国内武力紛争）場合を想定している。したがって難民の定義や受け入れ範囲の事実上の拡大とも言えよう。補完的保護対象者として認定されると、難民認定を受けた者と同様に、原則として在留資格「定住者」が付与され、当面の日常生活に必要な給付を受けるとともに帰国困難となった場合に備えて定住支援プログラムに参加でき、また永住要件も緩和される。また、難民旅行証明書の代わりに再入国許可書の交付を受けることができる。入管庁の発表によると今年2月までに補完的保護対象者認定申請をしたものは1110人であり、ウクライナ避難民を中心にそのうち647人が既に認定されている。今後、新たに申請する者を含め、審査が進むにつれて、補完的保護対象として認定される者はさらに増えるとみられる。今回の難民インタレストグループでは、難民認定と並び、今後の日本の難民政策に大きな影響を与えると思われる補完的保護制度を題材とし、本制度の導入の背景、仕組みと現況、今後の見通しなどについて、制度の検討・立案・導入にかかわってきた出入国在留管理庁・出入国管理部長の君塚宏氏にお話していただく。

＜特別企画：「新制度『育成就労』」の導入で、技能実習問題は『改善』されるのか？」＞

趣旨：
　2023年11月30日、技能実習制度及び特定技能制度の在り方に関する有識者会議は、技能実習制度を、実態に即して「発展的に解消」し、新たな制度を創設することを提言する最終報告書を法務大臣に提出しました。2024年2月9日、外国人材の受入れ・共生に関する関係閣僚会議において、提言を踏まえた政府の対応が了解され、3月15日、政府は新制度「育成就労」の創設に向けた入管法及び技能実習法の改定法案を閣議決定しました。
　新制度の目的は、人材確保と人材育成です。技能実習制度が労働力確保の目的で活用されてきた実態を、ようやく正面から認めたとも言えます。では、もう一方の「人材育成」とはどういうことでしょうか。
　2018年の入管法改定（翌19年施行）によって、深刻な労働力不足に対応するために、在留資格「特定技能」が創設されました。特定技能には、最長5年間で、家族の帯同が認められていない1号と、家族帯同が可能で、通算在留期間に制限のない2号があります。新制度は、未熟練労働者として受け入れた外国人を、特定技能1号に移行できる水準に育成しようというものです。つまり、外国人の出身国のためではなく、受入れ国である日本の労働力不足解消に資するよう、育成しようという制度です。そのため、新制度の受入れ対象分野は、特定技能制度における「特定産業分野」に一致させるとしています。
　そもそも冒頭の有識者会議が開催されることになったのは、技能実習法及び18年改定入管法の附則をうけてのものですが、その背景には、長年批判されてきた技能実習制度と拙速に導入した特定技能制度が、構造的に内包する「さまざまな問題」があります。であるならば、当然、新制度の導入によって、問題は解決されなければなりませんが、果たしてどうでしょうか。
　本特別企画では、育成就労制度の導入によって、技能実習問題が「改善」されうるのかということをテーマとして、外国人の権利保障、人材確保と人材育成という新制度の目的、特定技能への移行といった視点から、討議していきたいと思います。

企画趣旨：
　2020年以降のコロナ禍は人の移動の厳しい制限をもたらし、オンラインによるコミュニケーションなど人々の生活の変化に大きな影響を与えた。しかし、コロナ禍以降に再開された国内外の背景の異なる人たちの交流は地域によっては一層活発化して、さまざまな多文化によるグラスルーツの交流が展開されている。本シンポジウムでは、東京都心のエスニック・タウンと称される地域でも池袋地区に着目して、さまざまなアクターによる地域社会における多文化の連携の事例を紹介する。
　とくに豊島区池袋は、「ガチ中華」としてメディアで取り上げられるなど、中国出身者を中心としたエスニック・タウンとして注目を集めてきた。実際豊島区の外国人人口は中国出身者が多いという特徴を示すが、同時に近年は出身国の多様化が進んでいる。外国人住民の増加は単にエスニック・ビジネスの活発化ということだけでなく、受け入れた地域社会の変化にも結び付いてきた。エスニック社会としてホット・スポットである池袋地区であるが、産学官民による協働や連携も展開されている。実践的な活動や施策形成にかかわる方々による報告に基づき、今後の展望について検討する。多文化共生に向けたモデルの構築と発信を目指した企画である。

We cannot provide any special equipment such as routers for using wifi at the host venue. Please prepare your own. For university researchers, please use eduroam. You can connect to the wireless network with the SSID "eduroam" or "eduroam-XXX" (XXX is a random string of characters), so please have your university set up your ID and password in advance, and enter them at the venue in order to use the internet.

On the day of the conference, the JAMPS reception desk will be located in front of Flatten Hall in Building R. After registering, please move to Building G where the free presentations and thematic session will be held.

On the day of the conference, Building G, where the free presentations and thematic session will be held, will also be used by another academic society. Please be careful not to enter any rooms other than the ones reserved by JAMPS.
