趣旨：今回の難民インタレストグループのゲストは入管庁難民認定室長の菱田泰弘さんです。入管庁は、2014年末の「難民認定制度にかかる専門部会」の提言を受けて「難民認定ガイドライン」の策定を進めてきましたが、それは間もなく完成し公表される予定です。このガイドラインは日本が難民条約に加入して以来初めて策定されるのもので、アジア諸国で難民認定ガイドラインが公表されるのも初めてでしょう。ただ、最近、相互協力に関する覚書を締結したUNHCR本部からのコメントが遅れているなどのため、移民政策学会のある12月12日までにガイドラインが完成・公表されるかについては不透明のようです。そこで、当日までに公表されている場合には、「ガイドライン」の背景や考え方、主要ポイントについてお話ししていただきます。もし当日までに公表されていない場合には、ガイドラインの方向性や、入管法改正案にあった「補完的保護」、在留特別許可を直接求めることができる制度、出身国情報の拡充など、難民認定制度での改革についてお話をしていただきます。関心のある方は奮ってご参加ください。

＜シンポジウム：入管収容を考える―入管法改正をめぐる議論を中心に―＞

趣旨：
１．背景
2021年2月19日、政府は「出入国管理及び難民認定法及び日本国との平和条約に基づき日本の国籍を離脱した者等の出入国管理に関する特例法の一部を改正する法律案」（以下「本法案」とする）を閣議決定した。
本法案は第７次出入国管理政策懇談会「収容・送還に関する専門部会」による報告書「送還忌避・長期収容問題の解決に向けた提言」（2020年6月）を受けて作成されたもので、その発端は2019年6月に収容施設において被収容者が餓死したことが発端となった。
法案は4月には審議に入ったが、3月に名古屋入管における死亡事件に対する政府側の対応が厳しく問われたこともあり、5月17日に与野党が今国会での審議をこれ以上進めないことで合意がなされた。
本学会では、入管における「収容」に焦点を当て、行政、国際法、支援者の視点などから、課題とその対応について議論する機会とする。

２．目的
入管収容について、現場の声、政府の観点など多角的な視点を出し合い、国際人権法の規範も踏まえあるべき政策について考える機会とする。

趣旨：人々は、なぜ、どこに逃げるのか…。難民研究の原点ともいうべきこの問いに、昨年度の国際開発研究大来賞などを受賞した「平和構築を支援する～ミンダナオ紛争と和平への道」の著者が独自の視点で立ち向かいます。地理的に近いにもかかわらず、また紛争・暴力により100万人以上の国内避難民・難民・移民・無国籍者を生んだにもかかわらず、ミンダナオ紛争とその後の平和構築については日本ではほとんど知られていません。特に、マレーシア・サバ州に移動を強いられた難民・移民の帰還・再帰還の事例は、長期化した「避難生活」を経た帰還後の社会統合が容易ではないことを示します。国家の論理に翻弄され、紛争・暴力、さらには和平プロセスの長期化・複雑化によって繰り返し移動・移住を強いられ、その日常生活を根底から脅かされ、「人間の安全保障」を奪われる状況にあるフィリピン系の難民や移民への、地域のコンテキストに応じたより包括的な社会統合はどうあるべきかについて、学術的にも実践的にも極めて興味深い分析を紹介していただきます。また、日本の難民認定制度との関係では、出身国（地域）情報のありかたや国内避難可能性という視点からの問題提起もあり得るでしょう。

＜特別企画セッション：コロナ禍で考えるニューカマーの高齢化＞

趣旨：
　南米の日系人を中心としたニューカマーが多く来日するきっかけとなった1990年の入管法改正から30年が経過し，定住化・永住化が進んでいる。それに伴って高齢者となるニューカマーも増えている。たとえば，在日ブラジル人の場合，65歳以上の高齢者数は2012年12月末から2020年6月末の間に全国で2.3倍（4,244人→9,925人）に増加している（在留外国人統計）。彼らがどのように豊かな老後を過ごし，必要な介護を受け，尊厳ある最期を迎えるのかといった課題が生じてきている。
　言語や社会制度，生活様式が異なる日本で老いることや，最期を迎えるということは，ニューカマーたちにとってどのようなことを意味するのか。とりわけ，高齢者が重症化しやすい新型コロナウイルス感染症の蔓延は，「異国での老いや死」に関わる課題を顕在化させている。高齢者となったニューカマーは，どのような課題に直面し，どのようなニーズを抱えているのだろうか。そして，日本の高齢者政策は，彼らのニーズに応えているのだろうか。地域社会の一員としてこの国を長年支えてきたニューカマー高齢者に対して，責任あるホスト社会として日本はどのような環境や政策を用意すべきなのであろうか。
　本企画では，ニューカマーが多く居住する静岡県浜松市において，在日ブラジル人やさまざまな出身国のニューカマーを支援している実務家の方をお招きして現状と課題を伺うとともに，オールドカマーの高齢化という視点も踏まえつつ，コロナ禍でのニューカマーの高齢化について考える機会としたい。

＜シンポジウム：改定入管法施行後2年～特定技能制度と「総合的対応策」の現状と課題＞

趣旨：
　過去5年間に日本の出入国管理政策は大きく変わった。深刻化する人手不足に対応するため、2018年2月の経済財政諮問会議において、安倍首相（当時）は外国人労働者受入れについて、在留期間の上限を設定し家族の帯同は認めないという条件の下で早急に新しい制度設計をするよう官房長官と法務大臣に指示した。これを受け、同年6月の「経済財政運営と改革の基本方針」は、新たな在留資格を創設するとともに、法務省が、外国人の受入環境整備にかかる総合調整機能を持つ司令塔として関係省庁や地方公共団体と連携することとした。
　同年12月には出入国管理及び難民認定法が改正されて、一定の専門性と日本語能力を有する労働者の受け入れのために在留資格「特定技能」を創設し、受け入れのメドを5年間で34万5千人程度とすることが決定された。同時に外国人材の受入れ・共生に関する関係閣僚会議は、「外国人材の受入れ共生のための総合的対応策(以下総合的対応策)」を決定した。これには特定技能労働者と企業のマッチング、地方公共団体への外国人受け入れ環境整備交付金、「外国人在留支援センター」の設置、日本語教育の充実、外国人児童生徒の就学機会の確保など191の施策が含まれ、政府予算は200億円とされた。
　このように、政府は外国人労働者の正面からの受入れとそのための環境整備を早急ともいえるスピードで開始した。しかし、「特定技能」による受け入れは、送り出し国との調整の遅れやコロナ感染拡大防止のための入国制限もあり2021年1月末で18,613人(速報値)に止まる。他方で、多くの問題が指摘される技能実習生の受け入れは加速して2020年10月末時点で402,356人となった。留学生など他の在留資格からの移行も奨励されているが、「特定技能」の8割強が技能実習からの移行組であり、「国際貢献」と「労働者受け入れ」という目的の異なる２つの制度が「接ぎ木」されつつある。
　本シンポジウムでの問いは、日本の移民政策の大転換と喧伝された特定技能制度はなぜ進まないのか？国際的にも批判の多い技能実習制度が拡大を続ける理由は何か？入管庁による「総合的対応策」の省庁間調整は機能しているか？「当事者の声」を聴く体制は整っているか？技能実習と特定技能という趣旨の異なる制度が連結された政策は持続可能か？「ローテーション」「家族帯同禁止」「厳格な在留管理」により労働者の日本定着を防ぐ政策と、「外国人との共生社会」を目指すという政策の間に整合性はあるか？アジアで進む「人材獲得競争」の中で、日本の特定技能制度は国際的な競争力を持つか？などである。
　本シンポジウムはこれらの問いを含む特定技能制度の現状と課題について、政策担当者、登録支援機関、送り出し機関、当事者、そして支援団体という５つの観点から多角的に検討を行い、あるべき将来を展望する。

The JAMPS 2021 Annual Conference, scheduled to take place on Saturday May 29 to Sunday, May 30, will, due to the effect of the deteriorating circumstances surrounding the spread of Covid-19, no longer be held on- site. It will move, in its entirety to an online venue.

Prospective attendees who have already applied to participate on-site may join the Conference online. No additional registration procedures are necessary.

Further details regarding online participation will be sent in due course.

The JAMPS 2021 Annual Conference will be conducted on May 29 (Sat.) and 30 (Sun.) at Shizuoka University of Art and Culture in Hamamatsu City. The Conference will be held face-to-face, and you can also participate in all of the sessions except the Symposium and Special Session online.
Advance application is necessary in order to participate in the conference.
The application form will be available once the conference program is released in mid-April.

The Symposium and the Special Session will be recorded and available for JAMPS members after the conference.
